CANCELLATION

Cancellation by the User: In case of requests for order cancellations, Timetocart reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of usual business practice, if Timetocart receives a cancellation notice and the order has not been processed/ approved by Timetocart, Timetocart shall cancel the order and refund the entire amount to you within a reasonable period of time. Timetocart will not be able to cancel orders that have already been processed or dispatched. Timetocart has the full right to decide whether an order has been processed /dispatched or not. You agree not to dispute the decision made by Timetocart and accept Timetocart's decision regarding the cancellation.

Cancellation by Timetocart: There may be certain orders that Timetocart is unable to accept and must cancel. Timetocart reserves the right, at Timetocart's sole discretion, to refuse or cancel any order for any reason whatsoever. Some situations that may result in your order being cancelled include, without limitation, non-availability of the product or quantities ordered by you, non- availability of the service, inaccuracies or errors in pricing information, or problems identified by Timetocart's credit and fraud avoidance department.

Timetocart may also require additional verifications or information before accepting any order. Timetocart will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your credit card account. A coupon code, once used shall not be refunded in case of cancellation of order either by buyer or Timetocart.

Timetocart reserves the right to cancel any orders that classify as 'Bulk Order' as determined by Timetocart as per certain criteria. Any Timetocart coupon used for placing the 'Bulk Order' will not be refunded as per this cancellation policy. An order can be classified as 'Bulk Order' if it meets with the below mentioned criteria, which may not be exhaustive.

  • Products ordered are not for self-consumption but for commercial resale
  • Multiple orders placed for same product at the same address
  • Bulk quantity of the same product ordered
  • Invalid address given in order details
  • Any malpractice used to place the order

The right of cancellation does not apply to:

  • the delivery of products which are not suitable for return due to health protection or hygienic reasons if unsealed by you after delivery, or which are, after delivery, in separately mixed with other items
  • the supply of goods made to your specifications or clearly personalized
  • the supply of goods which may deteriorate or expire rapidly
  • a service if Timetocart has fully performed it and you accepted when you placed your order that we could start to deliver it, and that you could not cancel it once delivery had started
  • the delivery of sealed audio or video recordings or sealed software if unsealed by you after delivery
  • the supply of digital content (including apps, digital software, ebooks, MP3, etc) which is not supplied on a tangible medium (e.g. CD, DVD, USB stick, etc) if you accepted when you placed your order that we could start to deliver it, and that you could not cancel it once delivery had started
  • the delivery of newspapers, journals or magazines with the exception of subscription services
  • supply of products/goods (eg: alcoholic beverages) whose actual value is dependent on fluctuations in the market which we cannot control

REPLACEMENT GUARANTEE

Replacement is the action or process of replacing something in place of another. A buyer can request for replacement whenever he is not happy with the item, reason being damaged in shipping, defective item, item(s) missing, wrong item shipped and the like.

The Replacement guarantee seeks to assist buyers who have been defrauded by qualified sellers on the website. If at the time of delivery and/or within specified Seven (7) days from the date of delivery of the product, if any defect is found, then the buyer of the product can ask for replacement of the product from the seller.

If Timetocart has suspicion or knowledge, that any of its buyers and sellers are involved in any activity that is intended to provide claims or information that is false, misleading or not genuine, then Timetocart may while reserving its rights to initiate civil and/or criminal proceedings against user may also at its sole discretion suspend, block, restrict, cancel the display name of such buyer and seller and/or disqualify that user and any related users from availing protection through this scheme.

Timetocart reserves its right to initiate civil and/or criminal proceedings against a user who, files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, Timetocart may at its sole discretion suspend, block, restrict, cancel the account of such user and/or disqualify that user and any related users from availing protection through this program. Any person who knowingly and with intent to injure, defraud or deceive files fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.

The Seven (7) day replacement guarantee seeks to assist buyers who have been defrauded by qualified sellers on the website. If at the time of delivery and/or within seven (7) days from the date of delivery of the product, if any defect is found, then the buyer of the product can ask for replacement of the product from the seller subject to the following terms and conditions:

  • Notify seller of any defects in the product at the time of delivery of the product and/or within 7 days from the date of delivery and the same product will be replaced in return of the defective product.
  • Replacement can be for the entire product or part of the product subject to availability of the same with the seller.

Following products shall not be eligible for return or replacement:

  • Damages due to misuse of product
  • Incidental damage due to malfunctioning of product
  • Any consumable item which has been used/installed
  • Products with tampered or missing serial/UPC numbers
  • Digital products/services
  • Any damage/defect which are not covered under the manufacturer's warranty
  • Any product that is returned without all original packaging and accessories, including the box, manufacturer's packaging if any, and all other items originally included with the product delivered
  • Any personalised product on buyer's request (example: jewellery, innerwear, lingerie, socks, clothing, etc.)

On clothing, footwear and jewellery, qualified sellers accept 7 day exchange subject to the following conditions:

  • Original tags and packaging should be intact
  • For items that come in branded packaging, the box should be undamaged

Damaged or defective clothing and footwear products are meanwhile covered by the 7 day replacement guarantee.

Timetocart reserves its right to initiate civil and/or criminal proceedings against a user who, files an invalid and/or false claims or provides false, incomplete or misleading information. In addition to the legal proceedings as aforesaid, Timetocart may at its sole discretion suspend, block, restrict, cancel the user name of such user and/or disqualify that user and any related users from availing protection through this program. Any person who, knowingly and with intent to injure, defraud or deceive files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.

Points to be noted:

  • Seller can always accept the return irrespective of the policy
  • If seller disagrees for a return request, buyer can choose to raise a dispute by writing to resolve@timetocart.com.

Buyer need to raise the replacement request within 7 days from the date of delivery of products. Once buyer has raised a replacement request by contacting us on the website, the following steps shall be followed:

1. Buyer is asked for ‘Reason for return’. Among others, the following are the leading reasons:

  • Shipping was damaged
  • Item was defective
  • Item dead on arrival
  • Item(s) were missing
  • Wrong item sent

2. An intimation shall be provided to seller seeking either "approval" or "rejection" of the replacement request.

3. In case the seller accepts the replacement request, buyer shall be required to return the product to the seller and only after return of the product; seller shall be obliged to provide the replacement product to the buyer.

4. Incase seller rejects the replacement request; buyer can choose to raise a dispute by writing to resolve@timetocart.com.

In case the seller doesn't have the product at all, seller can provide the refund to the buyer and buyer shall be obligated to accept the refund in lieu of replacement. All the product parameters shall be required to be complied with in cases of replacement.

If the seller doesn't respond to the buyer's replacement request, within three days from the date of replacement request placed by the buyer, refund shall be processed in favour of buyer and seller shall be liable to refund amount paid to the seller.

All shipping and other replacement charges shall be borne and incurred by the seller.

RETURNS

In the event you receive a damaged / defective product or a product that does not comply with the specifications as per your original order, you are required to get in touch by emailing us at returns@timetocart.com.

Upon receiving your complaint, Timetocart shall verify the authenticity and the nature of the complaint and if Timetocart is convinced that the complaint is genuine, Timetocart will inform the relevant seller of such complaint and request for a replacement. However, in the event of frivolous and baseless complaints regarding the quality and content of the products, Timetocart reserves the right to take necessary legal actions against you and you will be solely liable for all costs incurred by Timetocart in this regard. You expressly acknowledge that the seller selling the defective product/ service will be solely responsible to you for any claims that you may have in relation to such defective product/service and Timetocart shall not in any manner be held liable for the same.

Before accepting shipment of any product, kindly ensure that the product's packaging is not damaged or tampered. If you observe that the package is damaged or tampered, we request you to refuse to accept delivery and inform Timetocart at the earliest. The return process of the product may be restricted by Timetocart depending on the nature and category of the product.

In order to return any products sold through the website, you are required to comply with the below mentioned conditions.

  • Products should be unused
  • Timetocart will arrange pick-up of the damaged/defective product through its own logistics partner. In the event Timetocart is unable to do so, Timetocart will notify you regarding the same and you will be required to dispatch the product using a reputed courier in your respective area within one (1) day from receipt of such notice. Courier freight charges will be reimbursed in such form as is determined by the logistics team upon prior consultation with Timetocart
  • Products should be returned in their original packaging along with the original price tags, labels, barcodes, user manual, warranty card, invoices, etc
  • It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of products during transit
  • The returned products are subject to verification and checks by Timetocart in order to determine the legitimacy of the complaint/return

Please notify Timetocart of receipt of a damaged/defective product/service within 48 hours of delivery to you. If you are unable to do so within 48 hours, Timetocart shall not be held liable for the failure to replace the order.

In the event the return of a product is duly accepted by Timetocart, the value of such product, as originally paid by you during acceptance of delivery of product or otherwise, will be refunded to you. Refund will be processed based on the mode of payment and Timetocart or the approved payment gateway will credit your refunds directly into your debit/credit card or online accounts or provide you with a cheque in this regard. Refunds will be subject to the following conditions.

  • Orders paid online will be refunded within 14 working days through the online account or via cheque, depending on the current circumstances as determined by Timetocart
  • For Cash on Delivery payments, you will be provided with a refund cheque
  • If the product can be repaired by the service centre, Timetocart would get the same repaired and send it back to you
  • A Coupon code, once used shall not be refunded in case of cancellation of order either by buyer or Timetocart

Return could also result in refund of money in most of the cases .Following situations may arise:

  • Item was defective
  • Item was damaged during the shipping
  • Products was/were missing
  • Wrong item was sent by the seller

Seller can always accept the return irrespective of the policy. We encourage the buyer to review the listing before making the purchase decision. In case buyer orders a wrong item, buyer shall not be entitled to any return/refund if the delivery of the product has started. In this case the buyer can still return the product but the shipping charge is borne by the buyer.

Buyer need to raise the refund request within 48-hours from the date of delivery of the product. Once buyer has raised a return request by contacting us/seller, closing the return ticket can be one of the following cases.

  • Replace after shipment collection - seller has agreed to wait for the logistics team to collect the shipment from the buyer before replacing it)
  • Refund after shipment collection - seller has agreed to wait for the logistics team to collect the shipment from the buyer before refunding
  • Refund without shipment collection - seller has agreed to refund the buyer without expecting the original shipment back
  • Replace without shipment collection - seller has agreed to replace the order without expecting the original shipment back

In the event the seller accepts the return request raised by the buyer, buyer will have to return the product and then the refund shall be credited to the buyers account.

In case the seller doesn't close the ticket in Three (3) days from the date of intimation to the seller about the refund request, the refund request shall be settled in favour of the buyer. If the seller disagrees with a return request, buyer can file a dispute under the User protection program.

Further for returns being made by buyer to the seller of the product, the following parameters needs to be ensured by the buyer:

  • Electronics - Should be "New & Unopened" with all accessories
  • Beauty, Health & Personal Care - Should be "new & unopened"
  • Clothing and Footwear - Should be "New & Unworn" (other than for trial) not altered, washed, soiled or damaged in any way
  • Jewellery - Should be "new" and returned with original packaging
  • Office Products - Should be "new" and returned with original packaging
  • Sports & Equipment - Should be "new" and returned with original packaging

If the product being returned is not in accordance with the above parameters, then buyer shall not be entitled to any refund of money from the seller.

Shipping cost for returning the product shall be borne and incurred by the seller.

STATUTORY RIGHT

Unless one of the exceptions listed below applies, you can cancel your order without giving any reason within 48 hours from the day on which you or a third party indicated by you (other than the carrier) receives the goods purchased (or last good, lot or piece if it relates to goods or multiple lots or pieces delivered separately) or from the day of the conclusion of the contract, in the case of services or digital content not supplied in a tangible medium (e.g. CD or DVD).

You must inform Timetocart of your decision to cancel your order. You may submit your request by contacting us. In case you use the return centre, we will communicate to you an acknowledgement of receipt by e-mail. To meet the cancellation deadline, it is sufficient for you to send your communication within 48 hours cancellation period has expired and return the item.

We will reimburse all payments received from you for the goods purchased and will also reimburse delivery charges for the least expensive type of delivery offered by us, no later than 14 days from the day on which we received the above communication. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. If reimbursement occurs after the maximum time period mentioned above, the amount due to you will as of right be increased.

Note that you must send back the goods by following the instructions in these terms no later than 7 days from the day on which you communicate your cancellation. You may be liable if the value of the goods returned diminishes due to the handling of the goods (except when it was necessary to establish the nature, characteristics and functioning of the goods).
